2. Purpose of the application

The FAME Live application is a digital assistant dedicated to creators of LIVE content on TikTok. It aims to educate creators to optimize their strategy, help them find opponents for LIVE matches to improve their monetization, better organize their schedule to optimize their visibility, and define growth objectives to increase their success.

Target users include TikTok LIVE content creators, whether individuals or agencies.

The main features offered are :

Search for opponents for LIVE matches
Educational material
LIVE performances
Setting objectives

3. Conditions of access and use

3.1 Eligibility requirements

The application is available to users of legal age (the minimum age for LIVE on TikTok is 18).

3.2 Device compatibility

The FAME Live application is compatible with mobile devices only.

4. Types of services offered

FAME Live offers three types of services:

Free version: Limited access to basic functions.
Paid version: Monthly or annual subscription to access advanced features.
Agency version: Content creators can benefit from a subscription paid for by their agencies.

Users can choose a monthly or annual subscription, depending on their needs.

5. Rules of use

FAME Live users must comply with the following rules:

No spamming or harassment of other users.
Respect other users and avoid offensive or illegal content.
Refrain from fraud, hacking, or any misuse of the application.
Do not share educational content provided by the application without authorization.
Avoid excessive use of the match search feature, which could lead to repeated cancellations.

6. Protection and intellectual property rights

The FAME Live application and all its contents (software, source code, interface, design, database, functionalities, texts, images, videos, etc.) are protected by intellectual property law. The application is registered with the Agence de Protection des Programmes (APP) under registration number IDDN.FR.001.260005.000.S.P.2024.000.00000. Any reproduction, modification, distribution or use without express authorization is strictly prohibited and may result in legal action.

7. Reverse Engineering Prohibition Clause

The User agrees not to attempt to decompile, disassemble, modify, adapt, reproduce, distribute or exploit in any way all or part of the FAME Live software. Any attempt to reverse engineer, extract code or analyze the internal workings of the application is strictly prohibited. Any violation of this prohibition will result in the immediate termination of the User's account, without prejudice to any legal action that FAME App may take to enforce its rights.

8. Reproduction and Derivation Prohibition Clause

The User acknowledges that the FAME Live application, including but not limited to its source code, algorithms, user interfaces and functionality, is the exclusive property of FAME App. The User is strictly prohibited from copying, reproducing, modifying, deriving or adapting any functionality, interface, logic or technology from the application for personal or commercial use, directly or indirectly. Any attempt to exploit or imitate the application, whether in whole or in part, may give rise to legal proceedings.

9. No Fraudulent Use of Accounts Clause

Registration and use of the FAME Live application are strictly personal and nominative. Users must register under their true identity and provide accurate information when creating their account.

It is strictly forbidden to:

Creating an account under a false identity or using false information.
Use or access another user's account, even with their consent.
Share, sell, lend or transfer your account to another person.
To have more than one active account for the same person, unless expressly authorized by FAME App.

Any breach of this clause may result in the suspension or permanent deletion of the account, without prior notice, as well as legal proceedings in the event of proven abuse.

10. Protection of personal data

FAME App collects the following data:

Personal information: first name, email, country, language, gender, TikTok name.
Usage data: number of matches found, interactions with application functions.

TikTok email addresses and names can be shared with partner agencies, if the user gives explicit consent via the application. This applies in particular to creators who are not currently affiliated with an agency but wish to join a FAME Live partner agency.

This data is used for :

Provide and improve application services.
Customize the user experience according to language and country.
Send promotional communications (only with the prior consent of the user).

11. Limitation of liability

FAME App cannot be held responsible for :

Technical problems.
Data loss.
Service interruption.

The user is responsible for the use he makes of the application and undertakes to respect the present conditions of use.

12. Termination

Users can cancel their account or subscription at any time via the download platform (App Store or Google Play Store).

In the event of a breach of these terms of use, FAME App reserves the right to suspend or terminate the user's account without notice.

13. Changes to the terms and conditions

FAME App reserves the right to modify these terms of use at any time. Users will be informed of changes by notification or email. Continued use of the application after such modifications constitutes acceptance of the new conditions.

14. Jurisdiction and applicable law

These terms of use are governed by French law. In the event of a dispute, the parties will endeavor to find an amicable solution. If no solution is found, the dispute will be submitted to the exclusive jurisdiction of the Marseille courts.

15. Additional terms for iOS users

For iOS users, this application is also governed by Apple's standard End User License Agreement (EULA). In the event of any conflict between these Terms of Use and Apple's EULA, the latter shall prevail for iOS users.

FAME Live privacy policy

This Privacy Policy describes how FAME App collects, uses and safeguards information about users of the FAME Live application.

We respect the confidentiality of your data and are committed to protecting it in accordance with current regulations, including the General Data Protection Regulation (GDPR) as well as Apple App Store and Google Play Store requirements.

1. Glossary

In the Privacy Policy, unless otherwise specified, the following words and expressions have the respective meanings indicated below:

Application: refers to the FAME Live application

CNIL: Commission Nationale de l'Informatique et des Libertés.

Personal Data: refers to any information relating to an identified or identifiable natural person.

Service provider: refers to all service providers with whom FAME Live has a contractual relationship.

Regulation: refers to Law no. 78-17 of January 6, 1978 relating to information technology, files and freedoms as amended, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "RGPD") as well as any regulations in force concerning the protection of Personal Data.

Data controller: means the natural or legal person, public authority, department or other body which, alone or jointly with others, determines the purposes and means of processing.

Subcontractor: refers to the natural or legal person, public authority, department or other body that processes Personal Data on behalf of the Data Controller.

Terminal: refers to the hardware equipment (telephone) that you use to consult or view the Site.

Processing or Treatment of personal data: means the collection, recording, organization, structuring, storage, adaptation or modification, retrieval, consultation, use or otherwise making available, alignment or combination, restriction, erasure or destruction.

User: refers to the person browsing the Application.

These definitions are capitalized and apply to both the singular and plural.

2. What is the scope of the Privacy Policy?

This Privacy Policy is intended for Users.

Consequently, access to the Application implies that you have read and accepted all the terms of the Privacy Policy, and therefore the collection and use of your Personal Data.

3. Who is involved in protecting personal data?

The controller of Personal Data is FAME Live, a simplified joint stock company, registered in the Marseille Trade and Companies Register under no. 932 507 841, whose registered office is located at 96, rue Paradis 13006 Marseille, for the Processing that it implements on the Personal Data collected from Users.

4. What is the nature of the Personal Data processed by FAME Live?

FAME Live takes into account the principles of data minimization, data protection by design and data protection by default. Consequently, information is collected that is relevant, adequate and limited to what is necessary for the purposes for which it is processed, and in particular for the operation of the Application.

This Personal Data is collected when you register for the Application or when you contact FAME Live.

When you choose to spontaneously send your Personal Data to FAME Live, without being asked to do so, you expressly consent to the collection of Personal Data and you agree to assume full responsibility for the Personal Data transmitted.

FAME Live processes the following Personal Data:

· Email (in case of manual registration with email address)

· TikTok username

· Language and country

5. What are the Processing purposes and legal bases?

FAME Live collects and processes Personal Data only if one of the following conditions is met:

- FAME Live has obtained your prior consent;

- Processing is necessary to comply with FAME Live's legal or regulatory obligations; or

- The Processing is necessary for the purposes of the legitimate interests pursued by FAME Live and does not unduly affect your interests or fundamental rights and freedoms.

5.1 On the basis of FAME Live's legitimate interest :

On the basis of legitimate interest, FAME Live carries out the following Processing operations:

· Optimization of services offered by the Application ;

· Personalizing the user experience by country and language.

· Analysis of Application performance in order to improve our services;

· Performance monitoring by the User's agency.

5.2 On the basis of Users' consent :

On the basis of Users' consent, FAME Live carries out the following Processing operations:

- Sending promotional communications if the User consents.

In this context, you may withdraw your consent at any time, without this withdrawal affecting the lawfulness of the Processing carried out by FAME Live prior to the said withdrawal.

5.3 On the basis of compliance with legal and regulatory obligations

FAME Live may also use your Personal Data to meet its legal and regulatory requirements, in particular concerning:

- Responding to security, anti-fraud or law enforcement requirements.

6. How long is Personal Data kept?

FAME Live retains your Personal Data for as long as is necessary for the fulfillment of the purposes for which it is to be used, subject to the legal possibilities of archiving, obligations to retain certain Personal Data and/or anonymization.

The Personal Data of Users of the Application are kept for a period of three (3) years from the last contact, subject to legal possibilities for archiving, obligations to keep certain Personal Data and/or anonymization.

7. Who receives your Personal Data?

FAME Live never passes on your Personal Data to third parties who may use them for their own purposes, in particular for commercial purposes and/or direct advertising.

FAME Live may share your Personal Data, only to the extent necessary, with :

- Its subcontractors, for the performance of tasks relating to the purposes described above (FAME Live's data host)

- Its partner agencies, so that they can follow their creators ;

- Public authorities: FAME Live may be obliged to communicate your Personal Data in response to a specific request made by a competent administrative or judicial authority, as well as more generally in all situations where the law, regulation or an administrative or judicial decision requires it.

8. How is your Personal Data stored?

Personal Data is stored on AWS servers located in Europe (Paris, eu-west-3 region).

The email addresses collected are stored by OneSignal to enable an OTP verification code to be sent upon registration or if the password is forgotten.

9. How is the security of Personal Data ensured?

FAME Live undertakes, within the framework of its activities and in accordance with the Regulations, to ensure the protection, confidentiality and security of Personal Data.

FAME Live takes the necessary precautions, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of the Processing as well as the probability of each risk, in order to preserve the security and confidentiality of the Personal Data that you communicate to it and in particular to prevent it from being deformed, damaged or communicated to third parties (except with your consent).

Consequently, FAME Live implements all technical, logical, physical and organizational measures to guarantee a level of security appropriate to the risk and to prevent any loss, alteration, disclosure of Personal Data or access by unauthorized third parties.

However, given the intrinsic characteristics of the Internet, any transmission of information via the Internet is not totally secure. Personal Data transmitted to FAME Live is subject to measures that cannot protect against all risks of misappropriation and/or piracy. The transmission of your Personal Data is therefore at your own risk.

In the event of a violation of Personal Data and in accordance with the Regulations, FAME Live undertakes to notify the CNIL.

10. Does FAME Live use cookies?

Cookies are small computer files stored on your Terminal's hard drive which record certain information in order to facilitate your browsing experience. They are deposited on your Terminal when you browse the Site.

FAME Live uses the following Cookies:

- Firebase Analytics: these analysis cookies provided by Google enable us to better understand User behavior.

Firebase Analytics collects aggregated and anonymized data, including:

- Application usage statistics (time spent, most frequently used features)

- Device and operating system information

- Track interactions with the application (clicks, navigation)

Analytical data are used as follows:

- Improved application functionality and performance

- Optimizing user experience

- Identification and resolution of technical problems

Anonymized data collected by Firebase Analytics may be stored on Google servers, including outside the European Union, to generate analyses.

FAME Live does not currently use cookies or third-party tracking technologies outside Firebase Analytics.

However, FAME Live may integrate third-party cookies or SDKs in the future to improve performance and user experience. Users will be informed prior to any such implementation and will have the opportunity to accept or decline such collection.

11. How can you manage/delete cookies?

Accepting this system does not expose you to any risk. Cookies do not damage your terminal.

Cookies are collected by Firebase Analytics only if you give your consent. Users may disable analytics tracking at any time.

12. Does FAME Live transfer Personal Data outside the European Union?

Your Personal Data may be transferred to a FAME Live Subcontractor located outside the European Union.

In the event of transfers, these are systematically based on an adequacy decision by the European Commission concerning the countries ensuring an adequate level of protection.

13. What are your rights?

FAME Live informs you that you benefit, under the terms and conditions provided for in the Regulations :

- A right to information: You have the right to receive clear, transparent and easily understandable information about how we use your information and your rights.

- A right of access: you have access to the Personal Data concerning you that FAME Live holds and processes.

- A right of rectification: you have the right to ask FAME Live to rectify information concerning you in the event of errors or inaccuracies.

- A right to object: where Processing is based on FAME Live's legitimate interests, you have the right to object, on legitimate grounds, to Processing of Personal Data. Please note that this right to object does not apply if our legitimate interests in continuing the Processing prevail over yours.

- A right to limitation of processing: you have the right to FAME Live not to keep some of your Personal Data for future processing when:

o You dispute the accuracy of your Personal Data;

o You consider and can establish that the Processing of Personal Data is unlawful and you object to the erasure of the Personal Data and demand instead the limitation of the Processing;

o FAME Live no longer requires your Personal Data but it is still necessary for the establishment, exercise or defence of legal claims;

o You object to the Processing being based on the legitimate interests of FAME Live, while the verification is being carried out as to whether the legitimate interests pursued by FAME Live prevail over those of the data subject.

- A right to erasure: subject to the exceptions provided for in the Regulations, you have the right to obtain from FAME Live the erasure of your Personal Data, where one of the following grounds applies:

o Your Personal Data are no longer necessary for the purposes for which they were collected or otherwise processed;

o You wish to withdraw your consent on which the Processing of your Personal Data was based and there is no other basis justifying such Processing;

o You object to the Processing and there are no compelling legitimate grounds for the Processing or you object to the sending of commercial solicitations;

o You consider and can establish that your Personal Data has been processed unlawfully;

o Your Personal Data must be deleted by virtue of a legal obligation.

- A right to the portability of your data : when the Processing is based on your consent or a contract, you have the right to receive from FAME Live the Personal Data concerning you in a structured, commonly used format, and to transmit this Personal Data to another controller without FAME Live hindering it.

Where technically possible, you may request that your Personal Data be transferred directly from FAME Live to another Data Controller.

- A right to withdraw consent: when Processing is based on your consent, you have the right to withdraw your consent at any time, without FAME Live being able to object.

- A right to decide what happens to your Personal Data after your death: Finally, you have the right to organize what happens to your Personal Data after your death by adopting general or specific directives. FAME Live undertakes to respect these directives. In the absence of directives, FAME Live recognizes the possibility for heirs to exercise certain rights, in particular the right of access, if it is necessary for the settlement of the deceased's estate; and the right of opposition to proceed with the closure of the deceased's user accounts and to oppose the Processing of their data.

If, despite FAME Live's efforts to preserve the confidentiality of your Personal Data, you believe that you have been the victim of a breach of the Regulations, you may submit a complaint to the national data protection authority: Commission Nationale de l'Informatique et des Libertés (CNIL), 3, place de Fontenoy - TSA 80715 -75334 Paris CEDEX 07 (+33 1 53 73 22 22 - www.cnil.fr ). You also have the right to seek redress from the competent courts if you consider that we have not respected your rights.

14. How can I be notified of changes to our privacy policy?

FAME Live reserves the right to modify its Privacy Policy. In the event of a major change, Users will be informed via a notification in the Application.

3. Voorwaarden voor toegang en gebruik

3.1 Voorwaarden voor subsidiabiliteit

De applicatie is beschikbaar voor gebruikers ouder dan 18 jaar (de minimumleeftijd om LIVE te gaan op TikTok is 18).

3.2 Compatibiliteit van apparaten

De FAME Live applicatie is alleen compatibel met mobiele apparaten.

4. Soorten aangeboden diensten

FAME Live biedt drie soorten diensten aan:

Gratis versie: Beperkte toegang tot basisfuncties.
Betaalde versie: Maandelijks of jaarlijks abonnement voor toegang tot geavanceerde functies.
Versie voor agentschappen: makers van inhoud kunnen profiteren van een abonnement dat wordt betaald door hun agentschappen.

Gebruikers kunnen kiezen voor een maandelijks of jaarlijks abonnement, afhankelijk van hun behoeften.

5. Regels voor gebruik

Gebruikers van FAME Live moeten zich aan de volgende regels houden:

Geen spamming of intimidatie van andere gebruikers.
Respecteer andere gebruikers en vermijd beledigende of illegale inhoud.
Zich te onthouden van fraude, piraterij of misbruik van de applicatie.
Deel de educatieve inhoud van de applicatie niet zonder toestemming.
Vermijd overmatig gebruik van de zoekfunctie voor wedstrijden, wat kan leiden tot herhaalde annuleringen.

6. Bescherming en intellectuele eigendomsrechten

De FAME Live applicatie en alle inhoud ervan (software, broncode, interface, ontwerp, database, functies, teksten, afbeeldingen, video's, enz. De applicatie is geregistreerd bij het Agence de Protection des Programmes (APP) onder registratienummer IDDN.FR.001.260005.000.S.P.2024.000.00000. Elke reproductie, wijziging, verspreiding of gebruik zonder uitdrukkelijke toestemming is strikt verboden en kan leiden tot gerechtelijke vervolging.

7. Clausule verbod op reverse engineering

De Gebruiker verbindt zich ertoe niet te proberen de FAME Live software of een deel ervan te decompileren, te demonteren, te wijzigen, aan te passen, te reproduceren, te verspreiden of te exploiteren op welke manier dan ook. Elke poging tot reverse engineering, het extraheren van code of het analyseren van de interne werking van de applicatie is strikt verboden. Elke inbreuk op dit verbod zal resulteren in de onmiddellijke beëindiging van de account van de Gebruiker, zonder afbreuk te doen aan de gerechtelijke stappen die FAME App kan ondernemen om zijn rechten af te dwingen.

8. Clausule inzake verbod op reproductie en afleiding

De Gebruiker erkent dat de FAME Live applicatie, met inbegrip van maar niet beperkt tot de broncode, algoritmen, gebruikersinterfaces en functionaliteit, de exclusieve eigendom is van FAME App. Het is de Gebruiker ten strengste verboden enige functionaliteit, interface, logica of technologie van de applicatie te kopiëren, reproduceren, wijzigen, af te leiden of aan te passen voor persoonlijk of commercieel gebruik, direct of indirect. Elke poging om de applicatie geheel of gedeeltelijk te exploiteren of na te maken kan aanleiding geven tot gerechtelijke vervolging.

9. Clausule die frauduleus gebruik van rekeningen verbiedt

Registratie en gebruik van de FAME Live applicatie zijn strikt persoonlijk en nominatief. Elke gebruiker moet zich onder zijn ware identiteit registreren en nauwkeurige informatie verstrekken bij het aanmaken van zijn account.

Het is ten strengste verboden om:

Een account aanmaken onder een valse identiteit of onjuiste informatie gebruiken.
De account van een andere gebruiker gebruiken of openen, zelfs met diens toestemming.
Uw account delen, verkopen, uitlenen of overdragen aan een andere persoon.
Het hebben van meerdere actieve accounts voor dezelfde persoon, tenzij uitdrukkelijk toegestaan door FAME App.

Elke inbreuk op deze clausule kan leiden tot de opschorting of permanente verwijdering van de account, zonder voorafgaande kennisgeving, evenals gerechtelijke procedures in geval van bewezen misbruik.

10. Bescherming van persoonlijke gegevens

FAME App verzamelt de volgende gegevens:

Persoonlijke gegevens: voornaam, e-mail, land, taal, geslacht, TikTok-naam.
Gebruiksgegevens: aantal gevonden overeenkomsten, interacties met de functies van de toepassing.

TikTok e-mailadressen en namen kunnen worden gedeeld met partnerbureaus als de gebruiker daar expliciet toestemming voor geeft via de applicatie. Dit geldt in het bijzonder voor makers die momenteel niet zijn aangesloten bij een agentschap, maar die zich willen aansluiten bij een FAME Live-partneragentschap.

Deze gegevens worden gebruikt voor :

Aanbieden en verbeteren van applicatieservices.
Pas de gebruikerservaring aan volgens taal en land.
Promotionele berichten te sturen (alleen met voorafgaande toestemming van de gebruiker).

11. Beperking van aansprakelijkheid

FAME App kan niet aansprakelijk worden gesteld in het geval van :

Technische problemen.
Verlies van gegevens.
Onderbreking van de dienst.

Gebruikers zijn verantwoordelijk voor hun gebruik van de applicatie en verbinden zich ertoe deze gebruiksvoorwaarden na te leven.

12. Beëindiging

Gebruikers kunnen hun account of abonnement op elk moment opzeggen via het downloadplatform (App Store of Google Play Store).

In geval van schending van deze gebruiksvoorwaarden behoudt FAME App zich het recht voor om de account van de gebruiker zonder kennisgeving op te schorten of te beëindigen.

13. Wijzigingen in de algemene voorwaarden

FAME App behoudt zich het recht voor deze gebruiksvoorwaarden te allen tijde te wijzigen. Gebruikers zullen van wijzigingen op de hoogte worden gesteld via een kennisgeving of e-mail. Voortgezet gebruik van de applicatie na dergelijke wijzigingen houdt aanvaarding in van de nieuwe voorwaarden.

14. Jurisdictie en toepasselijk recht

Op deze gebruiksvoorwaarden is het Franse recht van toepassing. In geval van een geschil zullen de partijen een minnelijke schikking nastreven. Als er geen oplossing wordt gevonden, zal het geschil worden onderworpen aan de exclusieve bevoegdheid van de rechtbanken van Marseille.

15. Aanvullende voorwaarden voor iOS-gebruikers

Voor iOS-gebruikers valt deze applicatie ook onder de standaard licentieovereenkomst voor eindgebruikers (EULA) van Apple. In het geval van een conflict tussen deze Gebruiksvoorwaarden en de EULA van Apple, prevaleert de laatste voor iOS-gebruikers.

Dit privacybeleid beschrijft hoe FAME App informatie over gebruikers van de FAME Live applicatie verzamelt, gebruikt en beschermt.

We respecteren de vertrouwelijkheid van je gegevens en zetten ons in om deze te beschermen in overeenstemming met de huidige regelgeving, waaronder de General Data Protection Regulation (GDPR) en de vereisten van de Apple App Store en Google Play Store.

In het Privacybeleid hebben de volgende uitdrukkingen en woorden, tenzij anders aangegeven, de respectieve betekenissen zoals hieronder aangegeven:

Applicatie: verwijst naar de FAME Live applicatie

CNIL: verwijst naar de Commission Nationale de l'Informatique et des Libertés.

Persoonsgegevens: verwijst naar alle informatie met betrekking tot een geïdentificeerde of identificeerbare natuurlijke persoon.

Dienstverlener: verwijst naar alle dienstverleners waarmee FAME Live een contractuele relatie heeft.

Verordening: betekent Wet nr. 78-17 van 6 januari 1978 betreffende gegevensverwerking, gegevensbestanden en individuele vrijheden, zoals gewijzigd, Verordening (EU) 2016/679 van het Europees Parlement en de Raad van 27 april 2016 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens en tot intrekking van Richtlijn 95/46/EG (hierna "RGPD") en alle van kracht zijnde verordeningen betreffende de bescherming van Persoonsgegevens.

Verantwoordelijke voor de verwerking: de natuurlijke of rechtspersoon, overheidsinstantie, dienst of andere instantie die, alleen of samen met anderen, het doel van en de middelen voor de verwerking vaststelt.

Subverwerker: verwijst naar de natuurlijke of rechtspersoon, overheidsinstantie, afdeling of andere instantie die Persoonsgegevens verwerkt namens de Verwerkingsverantwoordelijke.

Terminal: verwijst naar de hardwareapparatuur (telefoon) die u gebruikt om de Site te raadplegen of te bekijken.

Verwerking of Behandeling van persoonsgegevens: het verzamelen, vastleggen, ordenen, structureren, opslaan, bijwerken of wijzigen, opvragen, raadplegen, gebruiken of anderszins ter beschikking stellen, samenbrengen of combineren, beperken, wissen of vernietigen.

Gebruiker: verwijst naar de persoon die de Applicatie bekijkt.

Deze definities hebben een hoofdletter en zijn van toepassing op zowel het enkelvoud als het meervoud.

2. Wat is de reikwijdte van het vertrouwelijkheidsbeleid?

Dit Privacybeleid is bedoeld voor Gebruikers.

Dientengevolge houdt toegang tot de Applicatie in dat u alle voorwaarden van het Privacybeleid hebt gelezen en geaccepteerd, en dus ook de verzameling en het gebruik van uw Persoonsgegevens.

3. Wie is betrokken bij de bescherming van persoonlijke gegevens?

De verantwoordelijke voor de verwerking van de Persoonsgegevens is FAME Live, een vereenvoudigde naamloze vennootschap, ingeschreven in het handels- en vennootschapsregister van Marseille onder nr. 932 507 841, waarvan de maatschappelijke zetel gevestigd is te 96, rue Paradis 13006 Marseille voor de Verwerking die zij uitvoert op de Persoonsgegevens die zij van de Gebruikers heeft verzameld.

4. Wat is de aard van de Persoonsgegevens die door FAME Live worden verwerkt?

FAME Live houdt rekening met de principes van gegevensminimalisatie, gegevensbescherming door ontwerp en gegevensbescherming door standaard. Bijgevolg wordt informatie verzameld die relevant, toereikend en beperkt is tot wat noodzakelijk is met betrekking tot de doeleinden waarvoor ze wordt verwerkt, en in het bijzonder noodzakelijk voor het functioneren van de Applicatie.

Deze Persoonsgegevens worden verzameld wanneer u zich registreert voor de Applicatie of wanneer u contact opneemt met FAME Live.

Wanneer u ervoor kiest om uw Persoonsgegevens spontaan en ongevraagd naar FAME Live te sturen, stemt u uitdrukkelijk in met het verzamelen van Persoonsgegevens en aanvaardt u de volledige verantwoordelijkheid voor de doorgestuurde Persoonsgegevens.

FAME Live verwerkt de volgende Persoonsgegevens:

· E-mail (als je je handmatig registreert met je e-mailadres)

· TikTok-gebruikersnaam

· Taal en land

5. Wat zijn de doeleinden van de verwerking en de rechtsgrondslagen?

FAME Live verzamelt en verwerkt Persoonsgegevens alleen als aan een van de volgende voorwaarden wordt voldaan:

- FAME Live heeft uw voorafgaande toestemming;

- De verwerking is noodzakelijk om te voldoen aan de wettelijke of reglementaire verplichtingen van FAME Live; of

- De Verwerking is noodzakelijk voor de behartiging van de gerechtvaardigde belangen van FAME Live en laat uw belangen of fundamentele rechten en vrijheden onverlet.

5.1 Op basis van het legitieme belang van FAME Live :

Op basis van gerechtvaardigd belang voert FAME Live de volgende Verwerkingen uit:

· Optimalisatie van de door de Applicatie aangeboden diensten ;

· Aanpassing van de gebruikerservaring aan land en taal.

· Analyse van de prestaties van de Applicatie om onze diensten te verbeteren;

· Prestatiemonitoring door het agentschap van de gebruiker.

5.2 Op basis van toestemming van Gebruikers :

Op basis van de toestemming van Gebruikers voert FAME Live de volgende Verwerkingen uit:

- Het versturen van promotionele berichten als de Gebruiker hiermee instemt.

In dit kader kunt u uw toestemming te allen tijde intrekken, zonder dat deze intrekking invloed heeft op de rechtmatigheid van de Verwerking die FAME Live vóór de genoemde intrekking heeft uitgevoerd.

5.3 Op basis van naleving van wettelijke en reglementaire verplichtingen

FAME Live kan uw Persoonsgegevens ook gebruiken om te voldoen aan zijn wettelijke en reglementaire vereisten, in het bijzonder met betrekking tot:

- Reageren op beveiligings-, fraudebestrijdings- of wetshandhavingsvereisten.

6. Hoe lang worden persoonlijke gegevens bewaard?

FAME Live bewaart uw Persoonsgegevens zo lang als nodig is voor de verwezenlijking van de doeleinden waarvoor deze worden gebruikt, behoudens de wettelijke mogelijkheden van archivering, bewaarplicht van bepaalde Persoonsgegevens en/of anonimisering.

De Persoonsgegevens van Gebruikers van de Applicatie worden bewaard voor een periode van drie (3) jaar vanaf het laatste contact, behoudens de wettelijke mogelijkheden van archivering, bewaarplicht voor bepaalde Persoonsgegevens en/of anonimisering.

7. Wie ontvangt uw Persoonlijke Gegevens?

FAME Live geeft uw persoonsgegevens nooit door aan derden die deze voor hun eigen doeleinden kunnen gebruiken, met name voor commerciële doeleinden en/of directe reclame.

FAME Live kan uw Persoonsgegevens, uitsluitend voor zover noodzakelijk, delen met :

- haar Onderaannemers, voor het uitvoeren van taken met betrekking tot de hierboven beschreven doeleinden (FAME Live's data host)

- Haar partneragentschappen, zodat zij hun makers kunnen volgen;

- Overheidsinstanties: FAME Live kan verplicht worden om uw Persoonsgegevens mee te delen in antwoord op een specifiek verzoek van een bevoegde administratieve of gerechtelijke autoriteit, alsook meer in het algemeen in alle situaties waarin de wet, regelgeving of een administratieve of gerechtelijke beslissing dit vereist.

8. Hoe worden uw persoonlijke gegevens opgeslagen?

Persoonlijke gegevens worden opgeslagen op AWS-servers in Europa (Parijs, regio eu-west-3).

De verzamelde e-mailadressen worden opgeslagen door OneSignal zodat een OTP-verificatiecode kan worden verzonden wanneer je je registreert of wanneer je je wachtwoord bent vergeten.

9. Hoe wordt de beveiliging van Persoonsgegevens gewaarborgd?

In het kader van haar activiteiten en in overeenstemming met het Reglement, verbindt FAME Live zich ertoe de bescherming, de vertrouwelijkheid en de beveiliging van de Persoonsgegevens te waarborgen.

FAME Live neemt de nodige voorzorgsmaatregelen, rekening houdend met de stand van de techniek, de uitvoeringskosten en de aard, de omvang, de context en de doeleinden van de Verwerking, evenals de waarschijnlijkheid van elk risico, om de veiligheid en vertrouwelijkheid van de door u verstrekte Persoonsgegevens te bewaren en in het bijzonder om te voorkomen dat deze worden vervormd, beschadigd of aan derden worden meegedeeld (behalve met uw toestemming).

Bijgevolg legt FAME Live alle technische, logische, fysieke en organisatorische maatregelen ten uitvoer om een beveiligingsniveau te garanderen dat aangepast is aan het risico en om elk verlies, wijziging of openbaarmaking van Persoonsgegevens of toegang door onbevoegde derden te voorkomen.

Gezien de intrinsieke kenmerken van het internet is elke overdracht van informatie via het internet echter niet volledig veilig. De persoonsgegevens die naar FAME Live worden verzonden, zijn onderworpen aan maatregelen die niet kunnen beschermen tegen alle risico's van verduistering en/of piraterij. De overdracht van uw persoonsgegevens gebeurt dus op uw eigen risico.

In geval van een inbreuk op de Persoonsgegevens en in overeenstemming met het Reglement, verbindt FAME Live zich ertoe de CNIL op de hoogte te brengen.

10. Maakt FAME Live gebruik van cookies?

Cookies", d.w.z. kleine computerbestanden die op de harde schijf van uw Terminal worden opgeslagen en die bepaalde informatie registreren om uw surfervaring te vergemakkelijken, worden op uw Terminal geplaatst wanneer u op de Site surft.

FAME Live gebruikt de volgende cookies:

- Firebase Analytics: deze analysecookies van Google stellen ons in staat om het gedrag van gebruikers beter te begrijpen.

Firebase Analytics verzamelt geaggregeerde en geanonimiseerde gegevens, waaronder:

- Gebruiksstatistieken van applicaties (bestede tijd, meest gebruikte functies)

- Informatie over apparaat en besturingssysteem

- Bijhouden van interacties met de applicatie (klikken, navigatie)

Analytische gegevens worden als volgt gebruikt:

- De functionaliteit en prestaties van de applicatie verbeteren

- De gebruikerservaring optimaliseren

- Identificeren en oplossen van technische problemen

Geanonimiseerde gegevens verzameld door Firebase Analytics kunnen worden opgeslagen op servers van Google, ook buiten de Europese Unie, voor analytische doeleinden.

FAME Live maakt momenteel geen gebruik van cookies of trackingtechnologieën van derden buiten Firebase Analytics.

FAME Live kan echter in de toekomst cookies of SDK's van derden integreren om de prestaties en de gebruikerservaring te verbeteren. Gebruikers zullen voorafgaand aan een dergelijke implementatie worden geïnformeerd en hebben de mogelijkheid om een dergelijke verzameling te accepteren of te weigeren.

11. Hoe kunt u deze cookies beheren/verwijderen?

Door dit systeem te accepteren loopt u geen enkel risico. Cookies beschadigen uw terminal niet.

Cookies worden alleen verzameld door Firebase Analytics als u daar toestemming voor geeft. Gebruikers kunnen het bijhouden van analytics op elk gewenst moment uitschakelen.

12. Geeft FAME Live Persoonsgegevens door buiten de Europese Unie?

Uw persoonsgegevens kunnen worden doorgegeven aan een onderaannemer van FAME Live die buiten de Europese Unie is gevestigd.

Elke overdracht is systematisch gebaseerd op een adequaatheidsbesluit van de Europese Commissie met betrekking tot de landen die een adequaat beschermingsniveau bieden.

13. Wat zijn uw rechten?

FAME Live informeert u dat u profiteert, onder de voorwaarden en bepalingen zoals uiteengezet in het Reglement:

- Recht op informatie: je hebt het recht om duidelijke, transparante en gemakkelijk te begrijpen informatie te ontvangen over hoe we je informatie gebruiken en over je rechten.

- Een recht op toegang: u hebt toegang tot de Persoonsgegevens die op u betrekking hebben en die FAME Live bewaart en verwerkt.

- Recht op rectificatie: u hebt het recht om FAME Live te vragen om uw gegevens te rectificeren in geval van fouten of onnauwkeurigheden.

- Recht van bezwaar: indien de Verwerking is gebaseerd op de gerechtvaardigde belangen van FAME Live, heeft u het recht om op gerechtvaardigde gronden bezwaar te maken tegen de Verwerking van Persoonsgegevens. Houd er rekening mee dat dit recht om bezwaar te maken niet van toepassing is als onze legitieme belangen om de Verwerking voort te zetten prevaleren boven die van u.

- Een recht om de verwerking te beperken: u hebt het recht om FAME Live te vragen om sommige van uw Persoonsgegevens niet te bewaren voor toekomstige verwerking wanneer:

o U betwist de nauwkeurigheid van uw Persoonsgegevens;

o U van mening bent en kunt vaststellen dat de Verwerking van Persoonsgegevens onwettig is en u bezwaar maakt tegen het wissen van de Persoonsgegevens en in plaats daarvan de beperking van de Verwerking eist;

o FAME Live heeft uw Persoonsgegevens niet langer nodig, maar deze blijven noodzakelijk voor de vaststelling, uitoefening of verdediging van rechtsvorderingen;

o U maakt bezwaar tegen Verwerkingen die zijn gebaseerd op de gerechtvaardigde belangen van FAME Live, gedurende de verificatie of de gerechtvaardigde belangen die door FAME Live worden nagestreefd prevaleren boven die van de betrokkene.

- Recht op wissing: Behoudens de in de Verordening genoemde uitzonderingen, hebt u het recht om van FAME Live te verkrijgen dat uw Persoonsgegevens worden gewist, indien een van de volgende gronden van toepassing is:

o Uw Persoonsgegevens zijn niet langer noodzakelijk voor de doeleinden waarvoor ze zijn verzameld of anderszins verwerkt;

o U wenst uw toestemming waarop de Verwerking van uw Persoonsgegevens was gebaseerd in te trekken en er is geen andere grondslag voor een dergelijke Verwerking;

o U maakt bezwaar tegen de Verwerking en er zijn geen dwingende legitieme gronden voor de Verwerking of u maakt bezwaar tegen het verzenden van commerciële verzoeken;

o U van mening bent en kunt vaststellen dat uw Persoonsgegevens onrechtmatig zijn verwerkt;

o Uw Persoonsgegevens moeten worden verwijderd op grond van een wettelijke verplichting.

- Recht op overdraagbaarheid van uw gegevens : wanneer de Verwerking is gebaseerd op uw toestemming of een contract, hebt u het recht om van FAME Live de Persoonsgegevens die op u betrekking hebben in een gestructureerd, algemeen gebruikt formaat te ontvangen en om deze Persoonsgegevens naar een andere verwerkingsverantwoordelijke over te dragen zonder dat FAME Live dit belemmert.

Indien technisch mogelijk, kunt u verzoeken dat uw Persoonsgegevens rechtstreeks worden overgedragen van FAME Live naar een andere Gegevensverwerker.

- Een recht om toestemming in te trekken: indien de Verwerking is gebaseerd op uw toestemming, hebt u het recht om uw toestemming te allen tijde in te trekken, zonder dat FAME Live hiertegen bezwaar kan maken.

- Een recht om te beslissen wat er met uw Persoonsgegevens gebeurt na uw overlijden: Ten slotte hebt u het recht om te organiseren wat er met uw Persoonsgegevens gebeurt na uw overlijden door algemene of specifieke richtlijnen aan te nemen. FAME Live verbindt zich ertoe deze richtlijnen te respecteren. Bij gebrek aan richtlijnen erkent FAME Live de mogelijkheid voor de erfgenamen om bepaalde rechten uit te oefenen, met name het recht van toegang, indien dit noodzakelijk is voor de afwikkeling van de nalatenschap van de overledene; en het recht van verzet om over te gaan tot het afsluiten van de gebruikersaccounts van de overledene en om zich te verzetten tegen de Verwerking van hun gegevens.

U kunt uw rechten uitoefenen door een e-mail te sturen naar FAME Live op het volgende adres: support@fameapp.eu , samen met een kopie van uw identiteitsbewijs.

Indien u, ondanks de inspanningen van FAME Live om de vertrouwelijkheid van uw Persoonsgegevens te bewaren, van mening bent dat u het slachtoffer bent geworden van een inbreuk op de Verordeningen, kunt u een klacht indienen bij de nationale autoriteit voor gegevensbescherming: Commission Nationale de l'Informatique et des Libertés (CNIL), 3, place de Fontenoy - TSA 80715 -75334 Paris CEDEX 07 (+33 1 53 73 22 22 - www.cnil.fr ). U hebt ook het recht om verhaal te halen bij de bevoegde rechtbanken als u van mening bent dat wij uw rechten niet hebben gerespecteerd.

14. Hoe kan ik op de hoogte blijven van wijzigingen in ons privacybeleid?

FAME Live behoudt zich het recht voor om haar Privacybeleid te wijzigen. In het geval van een belangrijke wijziging zullen Gebruikers hiervan op de hoogte worden gesteld via een melding in de Applicatie.

3. Condições de acesso e uso

3.1 Condições de elegibilidade

O aplicativo está disponível para usuários maiores de 18 anos (a idade mínima para VIVER no TikTok é 18 anos).

3.2 Compatibilidade do dispositivo

O aplicativo FAME Live é compatível apenas com dispositivos móveis.

4. Tipos de serviços oferecidos

A FAME Live oferece três tipos de serviços:

Versão gratuita: acesso limitado às funções básicas.
Versão paga: Assinatura mensal ou anual para acesso a recursos avançados.
Versão para agências: os criadores de conteúdo podem se beneficiar de uma assinatura paga por suas agências.

Os usuários podem escolher uma assinatura mensal ou anual, dependendo de suas necessidades.

5. Regras de uso

Os usuários do FAME Live devem cumprir as seguintes regras:

Não envie spam ou assédio a outros usuários.
Respeite os outros usuários e evite qualquer conteúdo ofensivo ou ilegal.
Abster-se de fraude, pirataria ou qualquer uso indevido do aplicativo.
Não compartilhe o conteúdo educacional fornecido pelo aplicativo sem permissão.
Evite o uso excessivo da função de busca de correspondências, o que pode levar a cancelamentos repetidos.

6. Proteção e direitos de propriedade intelectual

O aplicativo FAME Live e todo o seu conteúdo (software, código-fonte, interface, design, banco de dados, funções, textos, imagens, vídeos, etc.) são protegidos pela lei de propriedade intelectual. 7. Cláusula de proibição de engenharia reversa

Qualquer tentativa de engenharia reversa, extração de código ou análise do funcionamento interno do aplicativo é estritamente proibida. Qualquer violação dessa proibição resultará no encerramento imediato da conta do usuário, sem prejuízo de qualquer ação legal que o aplicativo FAME possa tomar para fazer valer seus direitos.

8. Cláusula de proibição de reprodução e derivação

O usuário reconhece que o aplicativo FAME Live, incluindo, entre outros, seu código-fonte, algoritmos, interfaces de usuário e funcionalidade, é propriedade exclusiva do FAME. O usuário está estritamente proibido de copiar, reproduzir, modificar, derivar ou adaptar qualquer funcionalidade, interface, lógica ou tecnologia do aplicativo para uso pessoal ou comercial, direta ou indiretamente. Qualquer tentativa de explorar ou imitar o aplicativo, seja no todo ou em parte, pode dar origem a processos legais.

9. Cláusula que proíbe o uso fraudulento de contas

O registro e o uso do aplicativo FAME Live são estritamente pessoais e nominativos. Cada usuário deve se registrar com sua identidade verdadeira e fornecer informações precisas ao criar sua conta.

É estritamente proibido:

Criar uma conta com uma identidade falsa ou usar informações incorretas.
Usar ou acessar a conta de outro usuário, mesmo com seu consentimento.
Compartilhar, vender, emprestar ou transferir sua conta para outra pessoa.
Ter várias contas ativas para a mesma pessoa, a menos que expressamente autorizado pelo aplicativo FAME.

Qualquer violação desta cláusula poderá resultar na suspensão ou exclusão permanente da conta, sem aviso prévio, bem como em processos judiciais em caso de abuso comprovado.

10. Proteção de dados pessoais

O aplicativo FAME coleta os seguintes dados:

Informações pessoais: nome, e-mail, país, idioma, gênero, nome do TikTok.
Dados de uso: número de correspondências encontradas, interações com as funções do aplicativo.

Os endereços de e-mail e nomes do TikTok podem ser compartilhados com agências parceiras, se o usuário der consentimento explícito por meio do aplicativo. Isso se aplica especialmente aos criadores que não estão atualmente afiliados a uma agência, mas que desejam se juntar a uma agência parceira da FAME Live.

Esses dados são usados para :

Fornecer e aprimorar serviços de aplicativos.
Personalize a experiência do usuário de acordo com o idioma e o país.
Enviar comunicações promocionais (somente com o consentimento prévio do usuário).

11. Limitação de responsabilidade

O aplicativo FAME não pode ser responsabilizado em caso de :

Problemas técnicos.
Perda de dados.
Interrupção do serviço.

Os usuários são responsáveis pelo uso do aplicativo e se comprometem a cumprir estes termos de uso.

12. Rescisão

Os usuários podem cancelar sua conta ou assinatura a qualquer momento por meio da plataforma de download (App Store ou Google Play Store).

Em caso de violação destes termos de uso, o aplicativo FAME se reserva o direito de suspender ou encerrar a conta do usuário sem aviso prévio.

13. Alterações nos termos e condições

O aplicativo FAME se reserva o direito de modificar estas condições de uso a qualquer momento. Os usuários serão informados das alterações por notificação ou e-mail. O uso continuado do aplicativo após tais alterações constitui aceitação das novas condições.

14. Jurisdição e lei aplicável

Estas condições de uso são regidas pela legislação francesa. Em caso de litígio, as partes se esforçarão para encontrar uma solução amigável. Se não for encontrada uma solução, a disputa será submetida à jurisdição exclusiva dos tribunais de Marselha.

15. Termos adicionais para usuários do iOS

Para os usuários do iOS, este aplicativo também é regido pelo Contrato de Licença de Usuário Final (EULA) padrão da Apple. Em caso de conflito entre estes Termos de Uso e o EULA da Apple, este último prevalecerá para os usuários do iOS.

Controlador: significa a pessoa física ou jurídica, autoridade pública, agência ou outro órgão que, sozinho ou em conjunto com outros, determina as finalidades e os meios do processamento.

Subprocessador: refere-se à pessoa física ou jurídica, autoridade pública, departamento ou outro órgão que processa os Dados Pessoais em nome do Controlador.

Terminal: refere-se ao equipamento de hardware (telefone) que você usa para consultar ou visualizar o Site.

Processamento ou tratamento de dados pessoais: significa a coleta, o registro, a organização, a estruturação, o armazenamento, a adaptação ou alteração, a recuperação, a consulta, o uso ou a disponibilização, o alinhamento ou a combinação, a restrição, o apagamento ou a destruição.

Usuário: refere-se à pessoa que está navegando no Aplicativo.

Essas definições estão em letras maiúsculas e se aplicam tanto ao singular quanto ao plural.

2. Qual é o escopo da Política de Confidencialidade?

Esta Política de Privacidade é destinada aos Usuários.

Consequentemente, o acesso ao Aplicativo implica que você leu e aceitou todos os termos da Política de Privacidade e, portanto, a coleta e o uso dos seus Dados Pessoais.

4. Qual é a natureza dos dados pessoais processados pela FAME Live?

A FAME Live leva em conta os princípios de minimização de dados, proteção de dados desde a concepção e proteção de dados por padrão. 5. Quais são as finalidades do processamento e as bases legais?

A FAME Live coleta e processa dados pessoais somente se uma das seguintes condições for atendida:

- A FAME Live obteve seu consentimento prévio;

- O processamento é necessário para cumprir com as obrigações legais ou regulatórias da FAME Live; ou

- O processamento é necessário para os fins dos interesses legítimos da FAME Live e não afeta indevidamente seus interesses ou direitos e liberdades fundamentais.

5.1 Com base no interesse legítimo da FAME Live:

Com base em interesses legítimos, a FAME Live realiza as seguintes operações de processamento:

· Otimização dos serviços oferecidos pelo aplicativo;

· Personalização da experiência do usuário de acordo com o país e o idioma.

· Análise do desempenho do Aplicativo para melhorar nossos serviços;

· Monitoramento do desempenho pela agência do usuário.

5.2 Com base no consentimento dos Usuários:

Com base no consentimento dos usuários, a FAME Live realiza as seguintes operações de processamento:

- Envio de comunicações promocionais se o Usuário consentir.

Dentro dessa estrutura, o usuário pode retirar seu consentimento a qualquer momento, sem que essa retirada afete a legalidade do processamento realizado pela FAME Live antes da referida retirada.

5.3 Com base no cumprimento de obrigações legais e regulamentares

A FAME Live também pode usar seus dados pessoais para atender a requisitos legais e regulamentares, especialmente no que diz respeito a

- Responder a requisitos de segurança, antifraude ou de aplicação da lei.

6. Por quanto tempo os dados pessoais são mantidos?

A FAME Live retém seus dados pessoais pelo tempo necessário para o cumprimento das finalidades para as quais serão usados, sujeito às possibilidades legais de arquivamento, obrigações de retenção de determinados dados pessoais e/ou anonimização.

Os Dados Pessoais dos Usuários do Aplicativo são mantidos por um período de três (3) anos a partir do último contato, sujeito às possibilidades legais de arquivamento, obrigações de manter certos Dados Pessoais e/ou anonimização.

7. Quem recebe seus dados pessoais?

A FAME Live nunca transmite seus dados pessoais a terceiros, que podem usá-los para seus próprios fins, em particular para fins comerciais e/ou publicidade direta.

A FAME Live pode compartilhar seus dados pessoais, somente na medida do necessário, com :

- Seus subcontratados, para a execução de tarefas relacionadas às finalidades descritas acima (host de dados da FAME Live)

- Suas agências parceiras, para que possam acompanhar seus criadores;

- Autoridades públicas: a FAME Live pode ser obrigada a comunicar seus dados pessoais em resposta a uma solicitação específica feita por uma autoridade administrativa ou judicial competente, bem como, de forma mais geral, em todas as situações em que a lei, os regulamentos ou uma decisão administrativa ou judicial o exijam.

8. Como seus dados pessoais são armazenados?

Os Dados Pessoais são armazenados nos servidores da AWS localizados na Europa (Paris, região eu-west-3).

Os endereços de e-mail coletados são armazenados pela OneSignal para que um código de verificação OTP possa ser enviado quando você se registrar ou se esquecer sua senha.

9. Como a segurança dos dados pessoais é garantida?

No contexto de suas atividades e de acordo com os regulamentos, a FAME Live se compromete a garantir a proteção, a confidencialidade e a segurança dos dados pessoais.

A FAME Live tomará as precauções necessárias, levando em conta o estado da técnica, os custos de implementação e a natureza, o escopo, o contexto e as finalidades do processamento, bem como a probabilidade de cada risco, para preservar a segurança e a confidencialidade dos dados pessoais fornecidos pelo usuário e, em particular, para evitar que sejam distorcidos, danificados ou comunicados a terceiros (exceto com o consentimento do usuário).

Consequentemente, a FAME Live implementa todas as medidas técnicas, lógicas, físicas e organizacionais para garantir um nível de segurança adequado ao risco e para evitar qualquer perda, alteração, divulgação de dados pessoais ou acesso por terceiros não autorizados.

No entanto, dadas as características intrínsecas da Internet, qualquer transmissão de informações pela Internet não é totalmente segura. Os dados pessoais transmitidos à FAME Live estão sujeitos a medidas que não podem proteger contra todos os riscos de apropriação indevida e/ou pirataria. Portanto, a transmissão de seus dados pessoais é feita por sua própria conta e risco.

10. A FAME Live usa cookies?

Cookies", ou seja, pequenos arquivos de computador armazenados no disco rígido do seu Terminal que registram determinadas informações para facilitar sua experiência de navegação, são depositados no seu Terminal quando você navega no Site.

A FAME Live usa os seguintes cookies:

- Firebase Analytics: esses cookies de análise fornecidos pelo Google nos permitem entender melhor o comportamento do usuário.

O Firebase Analytics coleta dados agregados e anônimos, incluindo:

- Estatísticas de uso do aplicativo (tempo gasto, recursos usados com mais frequência)

- Informações sobre o dispositivo e o sistema operacional

- Rastreamento de interações com o aplicativo (cliques, navegação)

Os dados analíticos são usados da seguinte forma:

- Melhorar a funcionalidade e o desempenho do aplicativo

- Otimização da experiência do usuário

- Identificação e resolução de problemas técnicos

Os dados anônimos coletados pelo Firebase Analytics podem ser armazenados nos servidores do Google, inclusive fora da União Europeia, para fins analíticos.

Atualmente, a FAME Live não usa cookies ou tecnologias de rastreamento de terceiros fora do Firebase Analytics.

No entanto, a FAME Live pode integrar cookies ou SDKs de terceiros no futuro para melhorar o desempenho e a experiência do usuário. Os usuários serão informados antes de qualquer implementação desse tipo e terão a oportunidade de aceitar ou recusar essa coleta.

11. Como você pode gerenciar/excluir esses cookies?

A aceitação desse sistema não o expõe a nenhum risco. Os cookies não danificam seu Terminal.

Os cookies são coletados pelo Firebase Analytics somente se você der o seu consentimento. Os usuários podem desativar o rastreamento analítico a qualquer momento.

12. A FAME Live transfere dados pessoais para fora da União Europeia?

Seus dados pessoais podem ser transferidos para um subcontratado da FAME Live localizado fora da União Europeia.

Todas as transferências são sistematicamente baseadas em uma decisão de adequação da Comissão Europeia com relação aos países que oferecem um nível adequado de proteção.

13. Quais são seus direitos?

A FAME Live informa que você se beneficia, nos termos e condições estabelecidos nos Regulamentos:

- Direito de acesso: você tem acesso aos dados pessoais que lhe dizem respeito e que a FAME Live mantém e processa.

- Direito de retificação: o usuário tem o direito de solicitar à FAME Live que retifique as informações que lhe dizem respeito em caso de erros ou imprecisões.

- Direito de objeção: quando o processamento for baseado nos interesses legítimos da FAME Live, o usuário tem o direito de se opor, por motivos legítimos, ao processamento de dados pessoais. Observe que esse direito de objeção não se aplica se nossos interesses legítimos em continuar o processamento prevalecerem sobre os seus.

- Direito de limitar o processamento: o usuário tem o direito de solicitar à FAME Live que não mantenha alguns de seus dados pessoais para processamento futuro quando:

o Você contesta a precisão de seus Dados Pessoais;

o Você considera e pode estabelecer que o Processamento de Dados Pessoais é ilegal e se opõe à exclusão dos Dados Pessoais e exige, em vez disso, a restrição do Processamento;

o A FAME Live não precisa mais de seus dados pessoais, mas eles ainda são necessários para o estabelecimento, exercício ou defesa de reivindicações legais;

o Você se opõe ao Processamento e não há motivos legítimos convincentes para o Processamento ou você se opõe ao envio de solicitações comerciais;

o Você considera e pode estabelecer que seus dados pessoais foram processados ilegalmente;

o Seus Dados Pessoais devem ser excluídos em virtude de uma obrigação legal.

- Direito à portabilidade dos seus dados : quando o processamento for baseado no seu consentimento ou em um contrato, você tem o direito de receber da FAME Live os dados pessoais que lhe dizem respeito em um formato estruturado e comumente usado, e de transmitir esses dados pessoais a outro controlador sem que a FAME Live impeça isso.

Quando tecnicamente possível, o usuário pode solicitar que seus dados pessoais sejam transferidos diretamente da FAME Live para outro controlador de dados.

- Direito de retirar o consentimento: quando o processamento for baseado em seu consentimento, o usuário tem o direito de retirá-lo a qualquer momento, sem que a FAME Live possa se opor.

- Direito de decidir o que acontece com seus dados pessoais após sua morte: finalmente, você tem o direito de organizar o que acontece com seus dados pessoais após sua morte, adotando diretrizes gerais ou específicas. A FAME Live se compromete a respeitar essas diretrizes . 3. شروط الوصول والاستخدام

3.1 شروط الأهلية

التطبيق متاح للمستخدمين الذين تزيد أعمارهم عن 18 عامًا (الحد الأدنى لسن البث المباشر على TikTok هو 18 عامًا).

3.2 توافق الجهاز

تطبيق FAME Live متوافق فقط مع الأجهزة المحمولة.

4. أنواع الخدمات المقدمة

تقدم FAME Live ثلاثة أنواع من الخدمات:

الإصدار المجاني: وصول محدود إلى الوظائف الأساسية.
الإصدار المدفوع: اشتراك شهري أو سنوي للوصول إلى الميزات المتقدمة.
إصدار للوكالات: يمكن لمنشئي المحتوى الاستفادة من الاشتراك المدفوع من قبل وكالاتهم.

يمكن للمستخدمين اختيار اشتراك شهري أو سنوي، حسب احتياجاتهم.

5. قواعد الاستخدام

يجب أن يلتزم مستخدمو FAME Live بالقواعد التالية:

ممنوع إرسال رسائل غير مرغوب فيها أو مضايقة المستخدمين الآخرين.
احترم المستخدمين الآخرين وتجنب أي محتوى مسيء أو غير قانوني.
الامتناع عن الاحتيال أو القرصنة أو أي سوء استخدام للتطبيق.
لا تشارك المحتوى التعليمي الذي يقدمه التطبيق دون إذن.
تجنّب الاستخدام المفرط لوظيفة البحث عن التطابق، مما قد يؤدي إلى الإلغاء المتكرر.

6. الحماية وحقوق الملكية الفكرية

إن تطبيق FAME Live وجميع محتوياته (البرمجيات والرمز المصدري والواجهة والتصميم وقاعدة البيانات والوظائف والنصوص والصور ومقاطع الفيديو وغيرها) محمية بموجب قانون الملكية الفكرية. التطبيق مسجل لدى وكالة حماية البرامج (APP) تحت رقم التسجيل IDDN.FR.001.260005.000.000.S.P.2024.000.00000. يُحظر تمامًا أي استنساخ أو تعديل أو توزيع أو استخدام دون تصريح صريح وقد يؤدي إلى اتخاذ إجراءات قانونية.

7. بند حظر الهندسة العكسية

يتعهد المستخدم بعدم محاولة فك أو تفكيك أو تعديل أو تكييف أو إعادة إنتاج أو توزيع أو استغلال كل أو جزء من برنامج FAME Live بأي طريقة كانت. يحظر تمامًا أي محاولة لإجراء هندسة عكسية أو استخراج شيفرة أو تحليل طريقة العمل الداخلية للتطبيق. أي انتهاك لهذا الحظر سيؤدي إلى الإنهاء الفوري لحساب المستخدم، دون الإخلال بأي إجراء قانوني قد يتخذه تطبيق FAME لإنفاذ حقوقه.

8. بند حظر الاستنساخ والاشتقاق

يقرّ المستخدم بأن تطبيق فيم لايف، بما في ذلك على سبيل المثال لا الحصر شيفرة المصدر والخوارزميات وواجهات المستخدم ووظائفه، هو ملكية حصرية لتطبيق فيم لايف. يحظر على المستخدم منعاً باتاً نسخ أو إعادة إنتاج أو تعديل أو اشتقاق أو تكييف أي وظيفة أو واجهة أو منطق أو تقنية من التطبيق للاستخدام الشخصي أو التجاري، بشكل مباشر أو غير مباشر. قد تؤدي أي محاولة لاستغلال التطبيق أو تقليده، سواء كلياً أو جزئياً، إلى اتخاذ إجراءات قانونية.

9. بند حظر الاستخدام الاحتيالي للحسابات

التسجيل في تطبيق FAME Live واستخدامه شخصي واسمي بحت. يجب على كل مستخدم التسجيل بهويته الحقيقية وتقديم معلومات دقيقة عند إنشاء حسابه.

يُمنع منعاً باتاً:

إنشاء حساب بهوية مزيفة أو استخدام معلومات غير صحيحة.
استخدام حساب مستخدم آخر أو الوصول إليه، حتى بموافقته.
مشاركة حسابك أو بيعه أو إعارته أو تحويله إلى شخص آخر.
أن يكون لديك عدة حسابات نشطة لنفس الشخص، ما لم يصرح لك تطبيق FAME بذلك صراحةً.

قد يؤدي أي خرق لهذا البند إلى تعليق الحساب أو حذفه نهائيًا، دون إشعار مسبق، بالإضافة إلى اتخاذ إجراءات قانونية في حالة ثبوت إساءة الاستخدام.

10. حماية البيانات الشخصية

يجمع تطبيق FAME البيانات التالية:

المعلومات الشخصية: الاسم الأول، والبريد الإلكتروني، والبلد، واللغة، والجنس، واسم تيك توك.
بيانات الاستخدام: عدد التطابقات التي تم العثور عليها، والتفاعلات مع وظائف التطبيق.

قد تتم مشاركة عناوين البريد الإلكتروني وأسماء TikTok مع الوكالات الشريكة، إذا أعطى المستخدم موافقة صريحة عبر التطبيق. وينطبق هذا بشكل خاص على المبدعين الذين لا ينتمون حاليًا إلى وكالة ما ولكنهم يرغبون في الانضمام إلى وكالة شريكة لـ FAME Live.

تُستخدم هذه البيانات في :

توفير خدمات التطبيقات وتحسينها.

11. تحديد المسؤولية

لا يمكن تحميل تطبيق FAME المسؤولية في حالة :

مشاكل تقنية.
فقدان البيانات.
انقطاع الخدمة.

يتحمل المستخدمون مسؤولية استخدامهم للتطبيق ويتعهدون بالامتثال لشروط الاستخدام هذه.

12. الإنهاء

يمكن للمستخدمين إلغاء حسابهم أو اشتراكهم في أي وقت عبر منصة التنزيل (App Store أو Google Play Store).

في حالة خرق شروط الاستخدام هذه، يحتفظ تطبيق FAME بالحق في تعليق أو إنهاء حساب المستخدم دون إشعار مسبق.

13. التغييرات في الشروط والأحكام

يحتفظ تطبيق FAME بالحق في تعديل شروط الاستخدام هذه في أي وقت. سيتم إبلاغ المستخدمين بالتغييرات عن طريق الإخطار أو البريد الإلكتروني. يشكل الاستمرار في استخدام التطبيق بعد هذه التغييرات قبولاً للشروط الجديدة.

14. الولاية القضائية والقانون الواجب التطبيق

تخضع شروط الاستخدام هذه للقانون الفرنسي. في حالة حدوث نزاع، سيسعى الطرفان إلى إيجاد حل ودي. إذا لم يتم التوصل إلى حل، فسيتم إحالة النزاع إلى الاختصاص القضائي الحصري لمحاكم مرسيليا.

15. شروط إضافية لمستخدمي iOS

بالنسبة لمستخدمي نظام التشغيل iOS، يخضع هذا التطبيق أيضًا لاتفاقية ترخيص المستخدم النهائي القياسية من Apple (EULA). في حالة وجود تعارض بين شروط الاستخدام هذه واتفاقية ترخيص المستخدم النهائي من Apple، تسود الأخيرة بالنسبة لمستخدمي iOS.

4. ما هي طبيعة البيانات الشخصية التي يعالجها FAME Live؟

يأخذ تطبيق FAME Live في الاعتبار مبادئ تقليل البيانات وحماية البيانات حسب التصميم وحماية البيانات بشكل افتراضي. وبالتالي، يتم جمع المعلومات ذات الصلة والملائمة والمقتصرة على ما هو ضروري فيما يتعلق بالأغراض التي تتم معالجتها من أجلها، ولا سيما ما هو ضروري لتشغيل التطبيق.

5. ما هي أغراض المعالجة والأسس القانونية؟

يجمع FAME Live البيانات الشخصية ويعالجها فقط في حالة استيفاء أحد الشروط التالية:

- حصلت FAME Live على موافقتك المسبقة;

- المعالجة ضرورية للامتثال لالتزامات FAME Live القانونية أو التنظيمية؛ أو

- تُعد المعالجة ضرورية لأغراض المصالح المشروعة التي تسعى شركة FAME Live إلى تحقيقها ولا تؤثر بشكل غير ملائم على مصالحك أو حقوقك وحرياتك الأساسية.

5.1 على أساس المصلحة المشروعة لـ FAME Live :

على أساس المصلحة المشروعة، تقوم FAME Live بعمليات المعالجة التالية:

· تحسين الخدمات التي يقدمها التطبيق ;

· تخصيص تجربة المستخدم حسب البلد واللغة.

· تحليل أداء التطبيق من أجل تحسين خدماتنا;

· مراقبة الأداء من قبل وكالة المستخدم.

5.2 على أساس موافقة المستخدمين :

بناءً على موافقة المستخدمين، تقوم FAME Live بتنفيذ عمليات المعالجة التالية:

- إرسال مراسلات ترويجية إذا وافق المستخدم.

في هذا الإطار، يجوز لك سحب موافقتك في أي وقت، دون أن يؤثر هذا السحب على قانونية المعالجة التي أجرتها FAME Live قبل السحب المذكور.

5.3 على أساس الامتثال للالتزامات القانونية والتنظيمية

6. ما هي مدة الاحتفاظ بالبيانات الشخصية؟

يحتفظ FAME Live ببياناتك الشخصية طالما كان ذلك ضروريًا لتحقيق الأغراض التي ستُستخدم من أجلها، مع مراعاة الإمكانيات القانونية للأرشفة، والالتزامات بالاحتفاظ ببعض البيانات الشخصية و/أو إخفاء الهوية.

يتم الاحتفاظ بالبيانات الشخصية لمستخدمي التطبيق لمدة ثلاث (3) سنوات من آخر اتصال، مع مراعاة الإمكانيات القانونية للأرشفة، والالتزامات بالاحتفاظ ببعض البيانات الشخصية و/أو إخفاء الهوية.

7. من الذي سيتلقى بياناتك الشخصية؟

لا تقوم FAME Live بتمرير بياناتك الشخصية إلى أطراف ثالثة قد تستخدمها لأغراضها الخاصة، ولا سيما لأغراض تجارية و/أو إعلانات مباشرة.

قد يشارك FAME Live بياناتك الشخصية، بالقدر اللازم فقط، مع :

- مقاوليها من الباطن، لأداء المهام المتعلقة بالأغراض الموضحة أعلاه (مضيف بيانات FAME Live)

- الوكالات الشريكة لها، حتى يتمكنوا من متابعة مبدعيهم;

- السلطات العامة: قد تكون FAME Live ملزمة بإبلاغ بياناتك الشخصية استجابةً لطلب محدد مقدم من سلطة إدارية أو قضائية مختصة، وكذلك بشكل عام في جميع الحالات التي يتطلب فيها القانون أو اللوائح أو قرار إداري أو قضائي ذلك.

8. كيف يتم تخزين بياناتك الشخصية؟

تُخزَّن البيانات الشخصية على خوادم AWS الموجودة في أوروبا (باريس، المنطقة الأوروبية الغربية -3).

يتم تخزين عناوين البريد الإلكتروني التي تم جمعها بواسطة OneSignal بحيث يمكن إرسال رمز التحقق لمرة واحدة لمرة واحدة عند التسجيل أو إذا نسيت كلمة المرور الخاصة بك.

9. كيف يتم ضمان أمن البيانات الشخصية؟

في سياق أنشطتها ووفقاً للوائح، تتعهد FAME Live بضمان حماية البيانات الشخصية وسريتها وأمنها.

يجب على FAME Live اتخاذ الاحتياطات اللازمة، مع مراعاة أحدث ما توصلت إليه التكنولوجيا وتكاليف التنفيذ وطبيعة المعالجة ونطاقها وسياقها وأغراضها، وكذلك احتمال كل خطر، من أجل الحفاظ على أمن وسرية البيانات الشخصية التي تقدمها، وعلى وجه الخصوص، لمنع تشويهها أو إتلافها أو نقلها إلى أطراف ثالثة (إلا بموافقتك).

وبناءً على ذلك، تطبق FAME Live جميع التدابير التقنية والمنطقية والمادية والتنظيمية لضمان مستوى من الأمن يتناسب مع المخاطر ولمنع أي فقدان أو تغيير أو إفشاء للبيانات الشخصية أو الوصول إليها من قبل أطراف ثالثة غير مصرح لها.

10. هل يستخدم FAME Live ملفات تعريف الارتباط؟

- تحليلات Firebase Analytics: تُمكِّننا ملفات تعريف الارتباط التحليلية هذه التي تُقدِّمها Google من فهم سلوك المستخدم بشكل أفضل.

تجمع Firebase Analytics بيانات مجمعة ومجهولة المصدر، بما في ذلك :

- إحصائيات استخدام التطبيق (الوقت المستغرق، والميزات الأكثر استخداماً)

- معلومات الجهاز ونظام التشغيل

- تتبع التفاعلات مع التطبيق (النقرات، التصفح)

يتم استخدام البيانات التحليلية على النحو التالي:

- تحسين تجربة المستخدم

11. كيف يمكنك إدارة/حذف ملفات تعريف الارتباط هذه؟

قبول هذا النظام لا يعرضك لأي مخاطر. لا تضر ملفات تعريف الارتباط بجهازك الطرفي.

لا تجمع Firebase Analytics ملفات تعريف الارتباط إلا إذا أعطيت موافقتك. يمكن للمستخدمين تعطيل تتبع التحليلات في أي وقت.

12. هل تنقل FAME Live البيانات الشخصية خارج الاتحاد الأوروبي؟

قد تُنقل بياناتك الشخصية إلى أحد المتعاقدين من الباطن مع FAME Live الموجودين خارج الاتحاد الأوروبي.

تستند أي تحويلات بشكل منهجي إلى قرار كفاية من المفوضية الأوروبية بشأن البلدان التي توفر مستوى كافٍ من الحماية.

13. ما هي حقوقك؟

يعلمك FAME Live أنك تستفيد، بموجب الشروط والأحكام المنصوص عليها في اللوائح :
