2. Purpose of the Application

FAME Live is a digital assistant for TikTok LIVE content creators, aiming to educate creators to optimize their strategy, help them find opponents for LIVE matches to increase monetization, improve their organization for better visibility, and set growth goals for long-term success.

The target users are TikTok LIVE content creators, including individual creators and those managed by agencies.

The main features provided by the application are:

• Chat assistant

• Calendar

• Match opponent search for LIVE matches

• Educational material

• LIVE performances

• Goal setting

3. Access and Use Conditions

3.1 Eligibility

The application is available to users aged 18 or older (minimum age required to host LIVE sessions on TikTok).

3.2 Device Compatibility

The FAME Live application is compatible only with mobile devices.

4. Types of Services Offered

FAME Live offers three types of services:

• Free version: Limited access to basic features.

• Paid version: Monthly or yearly subscription for advanced features.

• Agency version: Creators can benefit from an agency-paid subscription.

Users can choose between a monthly or yearly subscription based on their needs.

5. Rules of Use

Users of FAME Live must follow these rules:

• No spamming or harassing other users.

• Respect others and avoid posting offensive or illegal content.

• Fraud, hacking, or any abusive use of the application is prohibited.

• Users may not share the educational content provided by the application without authorization.

• Avoid excessive use of the match search feature, which may lead to frequent cancellations.

6. Protection and Intellectual Property Rights

The FAME Live application and all of its content (software, source code, interface, design, database, features, texts, images, videos, etc.) are protected by intellectual property law. The application is registered with the Agence de Protection des Programmes (APP) under the deposit number IDDN.FR.001.260005.000.S.P.2024.000.00000. Any reproduction, modification, distribution, or exploitation without express authorization is strictly prohibited and may result in legal action.

7. Reverse Engineering Prohibition Clause

The User agrees not to attempt to decompile, disassemble, modify, adapt, reproduce, distribute, or exploit in any way, in whole or in part, the FAME.Live software. Any attempt at reverse engineering, code extraction, or analysis of the internal functioning of the application is strictly prohibited. Any violation of this prohibition will result in the immediate termination of the User's account, without prejudice to any legal action that FAME.App may take to enforce its rights.

8. Reproduction and Derivation Prohibition Clause

The User acknowledges that the FAME.Live application, including but not limited to its source code, algorithms, user interfaces, and functionalities, is the exclusive property of FAME.App. The User is strictly prohibited from copying, reproducing, modifying, deriving, or adapting any functionality, interface, logic, or technology from the application for personal or commercial use, directly or indirectly. Any attempt to exploit or imitate the application, whether in part or in whole, may lead to legal proceedings.

9. Prohibition of Fraudulent Account Use Clause

Registration and use of the FAME.Live application are strictly personal and nominative. Each user must register with their real identity and provide accurate information when creating their account.

It is strictly prohibited to:

• Create an account under a false identity or using incorrect information.

• Use or access another user's account, even with their consent.

• Share, sell, lend, or transfer an account to another person.

• Have multiple active accounts for the same person, except with explicit authorization from FAME.App.

Any violation of this clause may result in the suspension or permanent deletion of the account without notice, as well as legal action in case of proven abuse.

10. Personal Data Protection

FAME App collects the following data:

• Personal information: first name, email, country, language, gender, TikTok username.

• Usage data: number of matches found, interactions with the app's features.

Email addresses and TikTok usernames may be shared with partner agencies if the user consents. This applies especially to creators who are not currently affiliated with an agency but wish to join a partner agency of FAME Live.

The data collected is used to:

• Provide and improve the services of the application.

• Personalize the user experience based on language and country.

• Send promotional communications (with prior consent from the user).

11. Limitation of Liability

FAME App will not be held responsible for:

• Technical issues.

• Data loss.

• Service interruptions.

The user is responsible for their use of the application and agrees to comply with these terms.

12. Termination

Users may terminate their account or subscription at any time via the application or through the app store (Apple App Store, Google Play Store). Termination is subject to the same conditions as outlined in the Terms and Conditions of Sale.

In case of a violation of these terms, FAME App reserves the right to suspend or terminate the user's account without notice.

13. Modifications to the Terms

FAME App reserves the right to modify these terms of use at any time. Users will be notified of changes via the application or by email. Continued use of the application after such changes constitutes acceptance of the new terms.

14. Jurisdiction and Applicable Law

These terms of use are governed by French law. In the event of a dispute, the parties will attempt to resolve the issue amicably. If no agreement is reached, the courts of Marseille will have exclusive jurisdiction.

15. Additional Terms for iOS Users

For iOS users, this application is also governed by Apple’s Standard End User License Agreement (EULA). In the event of any conflict between these Terms of Use and Apple’s Standard EULA, the latter will prevail for iOS users.

This Privacy Policy describes how FAME App collects, uses and safeguards information about users of the FAME Live application.

We respect the confidentiality of your data and are committed to protecting it in accordance with current regulations, including the General Data Protection Regulation (GDPR) as well as Apple App Store and Google Play Store requirements.

1. Glossary

In the Privacy Policy, unless otherwise specified, the following words and expressions have the respective meanings indicated below:

Application: refers to the FAME Live application

CNIL: Commission Nationale de l'Informatique et des Libertés.

Personal Data: refers to any information relating to an identified or identifiable natural person.

Service provider: refers to all service providers with whom FAME Live has a contractual relationship.

Regulation: refers to Law no. 78-17 of January 6, 1978 relating to information technology, files and freedoms as amended, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "RGPD") as well as any regulations in force concerning the protection of Personal Data.

Data controller: means the natural or legal person, public authority, department or other body which, alone or jointly with others, determines the purposes and means of processing.

Subcontractor: refers to the natural or legal person, public authority, department or other body that processes Personal Data on behalf of the Data Controller.

Terminal: refers to the hardware equipment (telephone) that you use to consult or view the Site.

Processing or Treatment of personal data: means the collection, recording, organization, structuring, storage, adaptation or modification, retrieval, consultation, use or otherwise making available, alignment or combination, restriction, erasure or destruction.

User: refers to the person browsing the Application.

These definitions are capitalized and apply to both the singular and plural.

2. What is the scope of the Privacy Policy?

This Privacy Policy is intended for Users.

Consequently, access to the Application implies that you have read and accepted all the terms of the Privacy Policy, and therefore the collection and use of your Personal Data.

3. Who is involved in protecting personal data?

The controller of Personal Data is FAME Live, a simplified joint stock company, registered in the Marseille Trade and Companies Register under no. 932 507 841, whose registered office is located at 96, rue Paradis 13006 Marseille, for the Processing that it implements on the Personal Data collected from Users.

4. What is the nature of the Personal Data processed by FAME Live?

FAME Live takes into account the principles of data minimization, data protection by design and data protection by default. Consequently, information is collected that is relevant, adequate and limited to what is necessary for the purposes for which it is processed, and in particular for the operation of the Application.

This Personal Data is collected when you register for the Application or when you contact FAME Live.

When you choose to spontaneously send your Personal Data to FAME Live, without being asked to do so, you expressly consent to the collection of Personal Data and you agree to assume full responsibility for the Personal Data transmitted.

FAME Live processes the following Personal Data:

· Email (in case of manual registration with email address)

· TikTok username

· Language and country

5. What are the Processing purposes and legal bases?

FAME Live collects and processes Personal Data only if one of the following conditions is met:

- FAME Live has obtained your prior consent;

- Processing is necessary to comply with FAME Live's legal or regulatory obligations; or

- The Processing is necessary for the purposes of the legitimate interests pursued by FAME Live and does not unduly affect your interests or fundamental rights and freedoms.

5.1 On the basis of FAME Live's legitimate interest :

On the basis of legitimate interest, FAME Live carries out the following Processing operations:

· Optimization of services offered by the Application ;

· Personalizing the user experience by country and language.

· Analysis of Application performance in order to improve our services;

· Performance monitoring by the User's agency.

5.2 On the basis of Users' consent :

On the basis of Users' consent, FAME Live carries out the following Processing operations:

- Sending promotional communications if the User consents.

In this context, you may withdraw your consent at any time, without this withdrawal affecting the lawfulness of the Processing carried out by FAME Live prior to the said withdrawal.

5.3 On the basis of compliance with legal and regulatory obligations

FAME Live may also use your Personal Data to meet its legal and regulatory requirements, in particular concerning:

- Responding to security, anti-fraud or law enforcement requirements.

6. How long is Personal Data kept?

FAME Live retains your Personal Data for as long as is necessary for the fulfillment of the purposes for which it is to be used, subject to the legal possibilities of archiving, obligations to retain certain Personal Data and/or anonymization.

The Personal Data of Users of the Application are kept for a period of three (3) years from the last contact, subject to legal possibilities for archiving, obligations to keep certain Personal Data and/or anonymization.

7. Who receives your Personal Data?

FAME Live never passes on your Personal Data to third parties who may use them for their own purposes, in particular for commercial purposes and/or direct advertising.

FAME Live may share your Personal Data, only to the extent necessary, with :

- Its subcontractors, for the performance of tasks relating to the purposes described above (FAME Live's data host)

- Its partner agencies, so that they can follow their creators ;

- Public authorities: FAME Live may be obliged to communicate your Personal Data in response to a specific request made by a competent administrative or judicial authority, as well as more generally in all situations where the law, regulation or an administrative or judicial decision requires it.

8. How is your Personal Data stored?

Personal Data is stored on AWS servers located in Europe (Paris, eu-west-3 region).

The email addresses collected are stored by OneSignal to enable an OTP verification code to be sent upon registration or if the password is forgotten.

9. How is the security of Personal Data ensured?

FAME Live undertakes, within the framework of its activities and in accordance with the Regulations, to ensure the protection, confidentiality and security of Personal Data.

FAME Live takes the necessary precautions, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of the Processing as well as the probability of each risk, in order to preserve the security and confidentiality of the Personal Data that you communicate to it and in particular to prevent it from being deformed, damaged or communicated to third parties (except with your consent).

Consequently, FAME Live implements all technical, logical, physical and organizational measures to guarantee a level of security appropriate to the risk and to prevent any loss, alteration, disclosure of Personal Data or access by unauthorized third parties.

However, given the intrinsic characteristics of the Internet, any transmission of information via the Internet is not totally secure. Personal Data transmitted to FAME Live is subject to measures that cannot protect against all risks of misappropriation and/or piracy. The transmission of your Personal Data is therefore at your own risk.

In the event of a violation of Personal Data and in accordance with the Regulations, FAME Live undertakes to notify the CNIL.

10. Does FAME Live use cookies?

Cookies are small computer files stored on your Terminal's hard drive which record certain information in order to facilitate your browsing experience. They are deposited on your Terminal when you browse the Site.

FAME Live uses the following Cookies:

- Firebase Analytics: these analysis cookies provided by Google enable us to better understand User behavior.

Firebase Analytics collects aggregated and anonymized data, including:

- Application usage statistics (time spent, most frequently used features)

- Device and operating system information

- Track interactions with the application (clicks, navigation)

Analytical data are used as follows:

- Improved application functionality and performance

- Optimizing user experience

- Identification and resolution of technical problems

Anonymized data collected by Firebase Analytics may be stored on Google servers, including outside the European Union, to generate analyses.

FAME Live does not currently use cookies or third-party tracking technologies outside Firebase Analytics.

However, FAME Live may integrate third-party cookies or SDKs in the future to improve performance and user experience. Users will be informed prior to any such implementation and will have the opportunity to accept or decline such collection.

11. How can you manage/delete cookies?

Accepting this system does not expose you to any risk. Cookies do not damage your terminal.

Cookies are collected by Firebase Analytics only if you give your consent. Users may disable analytics tracking at any time.

12. Does FAME Live transfer Personal Data outside the European Union?

Your Personal Data may be transferred to a FAME Live Subcontractor located outside the European Union.

In the event of transfers, these are systematically based on an adequacy decision by the European Commission concerning the countries ensuring an adequate level of protection.

13. What are your rights?

FAME Live informs you that you benefit, under the terms and conditions provided for in the Regulations :

- A right to information: You have the right to receive clear, transparent and easily understandable information about how we use your information and your rights.

- A right of access: you have access to the Personal Data concerning you that FAME Live holds and processes.

- A right of rectification: you have the right to ask FAME Live to rectify information concerning you in the event of errors or inaccuracies.

- A right to object: where Processing is based on FAME Live's legitimate interests, you have the right to object, on legitimate grounds, to Processing of Personal Data. Please note that this right to object does not apply if our legitimate interests in continuing the Processing prevail over yours.

- A right to limitation of processing: you have the right to FAME Live not to keep some of your Personal Data for future processing when:

o You dispute the accuracy of your Personal Data;

o You consider and can establish that the Processing of Personal Data is unlawful and you object to the erasure of the Personal Data and demand instead the limitation of the Processing;

o FAME Live no longer requires your Personal Data but it is still necessary for the establishment, exercise or defence of legal claims;

o You object to the Processing being based on the legitimate interests of FAME Live, while the verification is being carried out as to whether the legitimate interests pursued by FAME Live prevail over those of the data subject.

- A right to erasure: subject to the exceptions provided for in the Regulations, you have the right to obtain from FAME Live the erasure of your Personal Data, where one of the following grounds applies:

o Your Personal Data are no longer necessary for the purposes for which they were collected or otherwise processed;

o You wish to withdraw your consent on which the Processing of your Personal Data was based and there is no other basis justifying such Processing;

o You object to the Processing and there are no compelling legitimate grounds for the Processing or you object to the sending of commercial solicitations;

o You consider and can establish that your Personal Data has been processed unlawfully;

o Your Personal Data must be deleted by virtue of a legal obligation.

- A right to the portability of your data : when the Processing is based on your consent or a contract, you have the right to receive from FAME Live the Personal Data concerning you in a structured, commonly used format, and to transmit this Personal Data to another controller without FAME Live hindering it.

Where technically possible, you may request that your Personal Data be transferred directly from FAME Live to another Data Controller.

- A right to withdraw consent: when Processing is based on your consent, you have the right to withdraw your consent at any time, without FAME Live being able to object.

- A right to decide what happens to your Personal Data after your death: Finally, you have the right to organize what happens to your Personal Data after your death by adopting general or specific directives. FAME Live undertakes to respect these directives. In the absence of directives, FAME Live recognizes the possibility for heirs to exercise certain rights, in particular the right of access, if it is necessary for the settlement of the deceased's estate; and the right of opposition to proceed with the closure of the deceased's user accounts and to oppose the Processing of their data.

· Aanpassing van de gebruikerservaring aan land en taal.

· Analyse van de prestaties van de Applicatie om onze diensten te verbeteren;

· Prestatiemonitoring door het agentschap van de gebruiker.

5.2 Op basis van toestemming van Gebruikers :

Op basis van de toestemming van Gebruikers voert FAME Live de volgende Verwerkingen uit:

- Het versturen van promotionele berichten als de Gebruiker hiermee instemt.

In dit kader kunt u uw toestemming te allen tijde intrekken, zonder dat deze intrekking invloed heeft op de rechtmatigheid van de Verwerking die FAME Live vóór de genoemde intrekking heeft uitgevoerd.

5.3 Op basis van naleving van wettelijke en reglementaire verplichtingen

FAME Live kan uw Persoonsgegevens ook gebruiken om te voldoen aan zijn wettelijke en reglementaire vereisten, in het bijzonder met betrekking tot:

- Reageren op beveiligings-, fraudebestrijdings- of wetshandhavingsvereisten.

6. Hoe lang worden persoonlijke gegevens bewaard?

FAME Live bewaart uw Persoonsgegevens zo lang als nodig is voor de verwezenlijking van de doeleinden waarvoor deze worden gebruikt, behoudens de wettelijke mogelijkheden van archivering, bewaarplicht van bepaalde Persoonsgegevens en/of anonimisering.

De Persoonsgegevens van Gebruikers van de Applicatie worden bewaard voor een periode van drie (3) jaar vanaf het laatste contact, behoudens de wettelijke mogelijkheden van archivering, bewaarplicht voor bepaalde Persoonsgegevens en/of anonimisering.

7. Wie ontvangt uw Persoonlijke Gegevens?

FAME Live geeft uw persoonsgegevens nooit door aan derden die deze voor hun eigen doeleinden kunnen gebruiken, met name voor commerciële doeleinden en/of directe reclame.

FAME Live kan uw Persoonsgegevens, uitsluitend voor zover noodzakelijk, delen met :

- haar Onderaannemers, voor het uitvoeren van taken met betrekking tot de hierboven beschreven doeleinden (FAME Live's data host)

- Haar partneragentschappen, zodat zij hun makers kunnen volgen;

- Overheidsinstanties: FAME Live kan verplicht worden om uw Persoonsgegevens mee te delen in antwoord op een specifiek verzoek van een bevoegde administratieve of gerechtelijke autoriteit, alsook meer in het algemeen in alle situaties waarin de wet, regelgeving of een administratieve of gerechtelijke beslissing dit vereist.

8. Hoe worden uw persoonlijke gegevens opgeslagen?

Persoonlijke gegevens worden opgeslagen op AWS-servers in Europa (Parijs, regio eu-west-3).

De verzamelde e-mailadressen worden opgeslagen door OneSignal zodat een OTP-verificatiecode kan worden verzonden wanneer je je registreert of wanneer je je wachtwoord bent vergeten.

9. Hoe wordt de beveiliging van Persoonsgegevens gewaarborgd?

In het kader van haar activiteiten en in overeenstemming met het Reglement, verbindt FAME Live zich ertoe de bescherming, de vertrouwelijkheid en de beveiliging van de Persoonsgegevens te waarborgen.

FAME Live neemt de nodige voorzorgsmaatregelen, rekening houdend met de stand van de techniek, de uitvoeringskosten en de aard, de omvang, de context en de doeleinden van de Verwerking, evenals de waarschijnlijkheid van elk risico, om de veiligheid en vertrouwelijkheid van de door u verstrekte Persoonsgegevens te bewaren en in het bijzonder om te voorkomen dat deze worden vervormd, beschadigd of aan derden worden meegedeeld (behalve met uw toestemming).

Bijgevolg legt FAME Live alle technische, logische, fysieke en organisatorische maatregelen ten uitvoer om een beveiligingsniveau te garanderen dat aangepast is aan het risico en om elk verlies, wijziging of openbaarmaking van Persoonsgegevens of toegang door onbevoegde derden te voorkomen.

Gezien de intrinsieke kenmerken van het internet is elke overdracht van informatie via het internet echter niet volledig veilig. De persoonsgegevens die naar FAME Live worden verzonden, zijn onderworpen aan maatregelen die niet kunnen beschermen tegen alle risico's van verduistering en/of piraterij. De overdracht van uw persoonsgegevens gebeurt dus op uw eigen risico.

In geval van een inbreuk op de Persoonsgegevens en in overeenstemming met het Reglement, verbindt FAME Live zich ertoe de CNIL op de hoogte te brengen.

10. Maakt FAME Live gebruik van cookies?

Cookies", d.w.z. kleine computerbestanden die op de harde schijf van uw Terminal worden opgeslagen en die bepaalde informatie registreren om uw surfervaring te vergemakkelijken, worden op uw Terminal geplaatst wanneer u op de Site surft.

FAME Live gebruikt de volgende cookies:

- Firebase Analytics: deze analysecookies van Google stellen ons in staat om het gedrag van gebruikers beter te begrijpen.

Firebase Analytics verzamelt geaggregeerde en geanonimiseerde gegevens, waaronder:

- Gebruiksstatistieken van applicaties (bestede tijd, meest gebruikte functies)

- Informatie over apparaat en besturingssysteem

- Bijhouden van interacties met de applicatie (klikken, navigatie)

Analytische gegevens worden als volgt gebruikt:

- De functionaliteit en prestaties van de applicatie verbeteren

- De gebruikerservaring optimaliseren

- Identificeren en oplossen van technische problemen

Geanonimiseerde gegevens verzameld door Firebase Analytics kunnen worden opgeslagen op servers van Google, ook buiten de Europese Unie, voor analytische doeleinden.

FAME Live maakt momenteel geen gebruik van cookies of trackingtechnologieën van derden buiten Firebase Analytics.

FAME Live kan echter in de toekomst cookies of SDK's van derden integreren om de prestaties en de gebruikerservaring te verbeteren. Gebruikers zullen voorafgaand aan een dergelijke implementatie worden geïnformeerd en hebben de mogelijkheid om een dergelijke verzameling te accepteren of te weigeren.

11. Hoe kunt u deze cookies beheren/verwijderen?

Door dit systeem te accepteren loopt u geen enkel risico. Cookies beschadigen uw terminal niet.

Cookies worden alleen verzameld door Firebase Analytics als u daar toestemming voor geeft. Gebruikers kunnen het bijhouden van analytics op elk gewenst moment uitschakelen.

12. Geeft FAME Live Persoonsgegevens door buiten de Europese Unie?

Uw persoonsgegevens kunnen worden doorgegeven aan een onderaannemer van FAME Live die buiten de Europese Unie is gevestigd.

Elke overdracht is systematisch gebaseerd op een adequaatheidsbesluit van de Europese Commissie met betrekking tot de landen die een adequaat beschermingsniveau bieden.

13. Wat zijn uw rechten?

FAME Live informeert u dat u profiteert, onder de voorwaarden en bepalingen zoals uiteengezet in het Reglement:

- Recht op informatie: je hebt het recht om duidelijke, transparante en gemakkelijk te begrijpen informatie te ontvangen over hoe we je informatie gebruiken en over je rechten.

- Een recht op toegang: u hebt toegang tot de Persoonsgegevens die op u betrekking hebben en die FAME Live bewaart en verwerkt.

- Recht op rectificatie: u hebt het recht om FAME Live te vragen om uw gegevens te rectificeren in geval van fouten of onnauwkeurigheden.

- Recht van bezwaar: indien de Verwerking is gebaseerd op de gerechtvaardigde belangen van FAME Live, heeft u het recht om op gerechtvaardigde gronden bezwaar te maken tegen de Verwerking van Persoonsgegevens. Houd er rekening mee dat dit recht om bezwaar te maken niet van toepassing is als onze legitieme belangen om de Verwerking voort te zetten prevaleren boven die van u.

- Een recht om de verwerking te beperken: u hebt het recht om FAME Live te vragen om sommige van uw Persoonsgegevens niet te bewaren voor toekomstige verwerking wanneer:

o U betwist de nauwkeurigheid van uw Persoonsgegevens;

o U van mening bent en kunt vaststellen dat de Verwerking van Persoonsgegevens onwettig is en u bezwaar maakt tegen het wissen van de Persoonsgegevens en in plaats daarvan de beperking van de Verwerking eist;

o FAME Live heeft uw Persoonsgegevens niet langer nodig, maar deze blijven noodzakelijk voor de vaststelling, uitoefening of verdediging van rechtsvorderingen;

o U maakt bezwaar tegen Verwerkingen die zijn gebaseerd op de gerechtvaardigde belangen van FAME Live, gedurende de verificatie of de gerechtvaardigde belangen die door FAME Live worden nagestreefd prevaleren boven die van de betrokkene.

- Recht op wissing: Behoudens de in de Verordening genoemde uitzonderingen, hebt u het recht om van FAME Live te verkrijgen dat uw Persoonsgegevens worden gewist, indien een van de volgende gronden van toepassing is:

o Uw Persoonsgegevens zijn niet langer noodzakelijk voor de doeleinden waarvoor ze zijn verzameld of anderszins verwerkt;

o U wenst uw toestemming waarop de Verwerking van uw Persoonsgegevens was gebaseerd in te trekken en er is geen andere grondslag voor een dergelijke Verwerking;

o U maakt bezwaar tegen de Verwerking en er zijn geen dwingende legitieme gronden voor de Verwerking of u maakt bezwaar tegen het verzenden van commerciële verzoeken;

o U van mening bent en kunt vaststellen dat uw Persoonsgegevens onrechtmatig zijn verwerkt;

o Uw Persoonsgegevens moeten worden verwijderd op grond van een wettelijke verplichting.

- Recht op overdraagbaarheid van uw gegevens : wanneer de Verwerking is gebaseerd op uw toestemming of een contract, hebt u het recht om van FAME Live de Persoonsgegevens die op u betrekking hebben in een gestructureerd, algemeen gebruikt formaat te ontvangen en om deze Persoonsgegevens naar een andere verwerkingsverantwoordelijke over te dragen zonder dat FAME Live dit belemmert.

Indien technisch mogelijk, kunt u verzoeken dat uw Persoonsgegevens rechtstreeks worden overgedragen van FAME Live naar een andere Gegevensverwerker.

- Een recht om toestemming in te trekken: indien de Verwerking is gebaseerd op uw toestemming, hebt u het recht om uw toestemming te allen tijde in te trekken, zonder dat FAME Live hiertegen bezwaar kan maken.

- Een recht om te beslissen wat er met uw Persoonsgegevens gebeurt na uw overlijden: Ten slotte hebt u het recht om te organiseren wat er met uw Persoonsgegevens gebeurt na uw overlijden door algemene of specifieke richtlijnen aan te nemen. FAME Live verbindt zich ertoe deze richtlijnen te respecteren. - A FAME Live obteve seu consentimento prévio;

- O processamento é necessário para cumprir com as obrigações legais ou regulatórias da FAME Live; ou

- O processamento é necessário para os fins dos interesses legítimos da FAME Live e não afeta indevidamente seus interesses ou direitos e liberdades fundamentais.

5.1 Com base no interesse legítimo da FAME Live:

Com base em interesses legítimos, a FAME Live realiza as seguintes operações de processamento:

· Otimização dos serviços oferecidos pelo aplicativo;

· Personalização da experiência do usuário de acordo com o país e o idioma.

· Análise do desempenho do Aplicativo para melhorar nossos serviços;

· Monitoramento do desempenho pela agência do usuário.

5.2 Com base no consentimento dos Usuários:

Com base no consentimento dos usuários, a FAME Live realiza as seguintes operações de processamento:

- Envio de comunicações promocionais se o Usuário consentir.

Dentro dessa estrutura, o usuário pode retirar seu consentimento a qualquer momento, sem que essa retirada afete a legalidade do processamento realizado pela FAME Live antes da referida retirada.

5.3 Com base no cumprimento de obrigações legais e regulamentares

A FAME Live também pode usar seus dados pessoais para atender a requisitos legais e regulamentares, especialmente no que diz respeito a

- Responder a requisitos de segurança, antifraude ou de aplicação da lei.

6. Por quanto tempo os dados pessoais são mantidos?

A FAME Live retém seus dados pessoais pelo tempo necessário para o cumprimento das finalidades para as quais serão usados, sujeito às possibilidades legais de arquivamento, obrigações de retenção de determinados dados pessoais e/ou anonimização.

Os Dados Pessoais dos Usuários do Aplicativo são mantidos por um período de três (3) anos a partir do último contato, sujeito às possibilidades legais de arquivamento, obrigações de manter certos Dados Pessoais e/ou anonimização.

7. Quem recebe seus dados pessoais?

A FAME Live nunca transmite seus dados pessoais a terceiros, que podem usá-los para seus próprios fins, em particular para fins comerciais e/ou publicidade direta.

A FAME Live pode compartilhar seus dados pessoais, somente na medida do necessário, com :

- Seus subcontratados, para a execução de tarefas relacionadas às finalidades descritas acima (host de dados da FAME Live)

- Suas agências parceiras, para que possam acompanhar seus criadores;

- Autoridades públicas: a FAME Live pode ser obrigada a comunicar seus dados pessoais em resposta a uma solicitação específica feita por uma autoridade administrativa ou judicial competente, bem como, de forma mais geral, em todas as situações em que a lei, os regulamentos ou uma decisão administrativa ou judicial o exijam.

8. Como seus dados pessoais são armazenados?

Os Dados Pessoais são armazenados nos servidores da AWS localizados na Europa (Paris, região eu-west-3).

Os endereços de e-mail coletados são armazenados pela OneSignal para que um código de verificação OTP possa ser enviado quando você se registrar ou se esquecer sua senha.

9. Como a segurança dos dados pessoais é garantida?

No contexto de suas atividades e de acordo com os regulamentos, a FAME Live se compromete a garantir a proteção, a confidencialidade e a segurança dos dados pessoais.

A FAME Live tomará as precauções necessárias, levando em conta o estado da técnica, os custos de implementação e a natureza, o escopo, o contexto e as finalidades do processamento, bem como a probabilidade de cada risco, para preservar a segurança e a confidencialidade dos dados pessoais fornecidos pelo usuário e, em particular, para evitar que sejam distorcidos, danificados ou comunicados a terceiros (exceto com o consentimento do usuário).

Consequentemente, a FAME Live implementa todas as medidas técnicas, lógicas, físicas e organizacionais para garantir um nível de segurança adequado ao risco e para evitar qualquer perda, alteração, divulgação de dados pessoais ou acesso por terceiros não autorizados.

No entanto, dadas as características intrínsecas da Internet, qualquer transmissão de informações pela Internet não é totalmente segura. Os dados pessoais transmitidos à FAME Live estão sujeitos a medidas que não podem proteger contra todos os riscos de apropriação indevida e/ou pirataria. Portanto, a transmissão de seus dados pessoais é feita por sua própria conta e risco.

- Rastreamento de interações com o aplicativo (cliques, navegação)

Os dados analíticos são usados da seguinte forma:

Os dados anônimos coletados pelo Firebase Analytics podem ser armazenados nos servidores do Google, inclusive fora da União Europeia, para fins analíticos.

Atualmente, a FAME Live não usa cookies ou tecnologias de rastreamento de terceiros fora do Firebase Analytics.

No entanto, a FAME Live pode integrar cookies ou SDKs de terceiros no futuro para melhorar o desempenho e a experiência do usuário. Os usuários serão informados antes de qualquer implementação desse tipo e terão a oportunidade de aceitar ou recusar essa coleta.

12. A FAME Live transfere dados pessoais para fora da União Europeia?

Seus dados pessoais podem ser transferidos para um subcontratado da FAME Live localizado fora da União Europeia.

A FAME Live informa que você se beneficia, nos termos e condições estabelecidos nos Regulamentos:

- Direito de acesso: você tem acesso aos dados pessoais que lhe dizem respeito e que a FAME Live mantém e processa.

- Direito de retificação: o usuário tem o direito de solicitar à FAME Live que retifique as informações que lhe dizem respeito em caso de erros ou imprecisões.

- Direito de objeção: quando o processamento for baseado nos interesses legítimos da FAME Live, o usuário tem o direito de se opor, por motivos legítimos, ao processamento de dados pessoais. Observe que esse direito de objeção não se aplica se nossos interesses legítimos em continuar o processamento prevalecerem sobre os seus.

- Direito de limitar o processamento: o usuário tem o direito de solicitar à FAME Live que não mantenha alguns de seus dados pessoais para processamento futuro quando:

o Você contesta a precisão de seus Dados Pessoais;

o Você considera e pode estabelecer que o Processamento de Dados Pessoais é ilegal e se opõe à exclusão dos Dados Pessoais e exige, em vez disso, a restrição do Processamento;

o A FAME Live não precisa mais de seus dados pessoais, mas eles ainda são necessários para o estabelecimento, exercício ou defesa de reivindicações legais;

o Você se opõe ao Processamento e não há motivos legítimos convincentes para o Processamento ou você se opõe ao envio de solicitações comerciais;

o Você considera e pode estabelecer que seus dados pessoais foram processados ilegalmente;

- حصلت FAME Live على موافقتك المسبقة;

- المعالجة ضرورية للامتثال لالتزامات FAME Live القانونية أو التنظيمية؛ أو

- تُعد المعالجة ضرورية لأغراض المصالح المشروعة التي تسعى شركة FAME Live إلى تحقيقها ولا تؤثر بشكل غير ملائم على مصالحك أو حقوقك وحرياتك الأساسية.

5.1 على أساس المصلحة المشروعة لـ FAME Live :

على أساس المصلحة المشروعة، تقوم FAME Live بعمليات المعالجة التالية:

· تحسين الخدمات التي يقدمها التطبيق ;

· تخصيص تجربة المستخدم حسب البلد واللغة.

· تحليل أداء التطبيق من أجل تحسين خدماتنا;

· مراقبة الأداء من قبل وكالة المستخدم.

5.2 على أساس موافقة المستخدمين :

بناءً على موافقة المستخدمين، تقوم FAME Live بتنفيذ عمليات المعالجة التالية:

- إرسال مراسلات ترويجية إذا وافق المستخدم.

7. من الذي سيتلقى بياناتك الشخصية؟

لا تقوم FAME Live بتمرير بياناتك الشخصية إلى أطراف ثالثة قد تستخدمها لأغراضها الخاصة، ولا سيما لأغراض تجارية و/أو إعلانات مباشرة.

قد يشارك FAME Live بياناتك الشخصية، بالقدر اللازم فقط، مع :

8. كيف يتم تخزين بياناتك الشخصية؟

تُخزَّن البيانات الشخصية على خوادم AWS الموجودة في أوروبا (باريس، المنطقة الأوروبية الغربية -3).

يتم تخزين عناوين البريد الإلكتروني التي تم جمعها بواسطة OneSignal بحيث يمكن إرسال رمز التحقق لمرة واحدة لمرة واحدة عند التسجيل أو إذا نسيت كلمة المرور الخاصة بك.

9. كيف يتم ضمان أمن البيانات الشخصية؟

في سياق أنشطتها ووفقاً للوائح، تتعهد FAME Live بضمان حماية البيانات الشخصية وسريتها وأمنها.

يجب على FAME Live اتخاذ الاحتياطات اللازمة، مع مراعاة أحدث ما توصلت إليه التكنولوجيا وتكاليف التنفيذ وطبيعة المعالجة ونطاقها وسياقها وأغراضها، وكذلك احتمال كل خطر، من أجل الحفاظ على أمن وسرية البيانات الشخصية التي تقدمها، وعلى وجه الخصوص، لمنع تشويهها أو إتلافها أو نقلها إلى أطراف ثالثة (إلا بموافقتك).

- تتبع التفاعلات مع التطبيق (النقرات، التصفح)

لا يستخدم FAME Live حاليًا ملفات تعريف الارتباط أو تقنيات التتبع الخاصة بطرف ثالث خارج Firebase Analytics.

لا تجمع Firebase Analytics ملفات تعريف الارتباط إلا إذا أعطيت موافقتك. يمكن للمستخدمين تعطيل تتبع التحليلات في أي وقت.

12. هل تنقل FAME Live البيانات الشخصية خارج الاتحاد الأوروبي؟

قد تُنقل بياناتك الشخصية إلى أحد المتعاقدين من الباطن مع FAME Live الموجودين خارج الاتحاد الأوروبي.

تستند أي تحويلات بشكل منهجي إلى قرار كفاية من المفوضية الأوروبية بشأن البلدان التي توفر مستوى كافٍ من الحماية.

13. ما هي حقوقك؟
